Appeals Court Rejects Trump Order Ending Birthright Citizenship

A federal appeals court in Boston has ruled that President Donald Trump’s executive order to revoke birthright citizenship is unconstitutional and cannot be enforced, as reported by AP.
The 1st U.S. Circuit Court of Appeals upheld lower court injunctions blocking the policy, finding the Trump order likely violates the 14th Amendment’s Citizenship Clause. The court emphasized that children born on U.S. soil remain citizens, regardless of their parents’ immigration status. It also warned against redefining citizenship based on parentage, calling the proposed shift “at odds with our established tradition.
The ruling adds to a string of judicial setbacks for the administration’s immigration agenda. The appeals court said the government failed to show that enforcing the order would avoid harm, and maintained the injunction while litigation proceeds.
The ‘lessons of history’ give us every reason to be wary of now blessing this … effort to break with our established tradition of recognizing birthright citizenship,” the court wrote.
The administration is expected to seek Supreme Court review. In the meantime, birthright citizenship remains protected across the country as courts continue to assess the legality of the contested executive order.
