DHS Says ICE Agents Will Not Comply With California Mask Ban

The Department of Homeland Security has said Immigration and Customs Enforcement agents will not comply with California’s new law banning most law enforcement officers from wearing masks during operations.
Governor Gavin Newsom signed the “No Secret Police Act” earlier this month, which prohibits officers from using balaclavas, ski masks, or similar face coverings while on duty.
The New law, set to take effect in January 2026, includes exceptions for undercover work, medical protection, and tactical gear.
A DHS spokeswoman called the law unconstitutional and said ICE agents need face coverings to protect themselves from threats and harassment.
She said the agency would continue to allow masks when necessary for officer safety.
Supporters of the legislation argue it improves accountability and transparency, while critics warn it could endanger federal officers and lead to legal challenges in court.
