President Donald Trump’s administration has formally asked the U.S. Supreme Court to review and uphold an executive order that denying automatic citizenship to all children born in the United States to parents who do not have any legal status or temporary visas, after lower courts blocked the order as unconstitutional. according to AP
The order, signed on January 20, 2025, challenges longstanding implementation of the 14th Amendment, which grants citizenship to all children born on American soil.
Lower courts in Washington and New Hampshire have already issued injunctions preventing enforcement.
In its petition, filed by Solicitor General D. John Sauer, the administration argues that the Citizenship Amendment Act was never intended to include children born to illegal aliens or temporary visitors.
The filing requests that the Supreme Court Will reconsider lower-court bans that have barred enforcement.
Opponents, including the American Civil Liberties Union, insist that the order violates constitutional protections and aim to vigorously challenge it in court.
Several judges have called the policy unconstitutional, citing the near universality of citizenship in U.S. law.
If the Supreme Court accepts the case, arguments are scheduled for the winter or spring, with a final decision expected in early summer 2026.
