U.S. Citizen Shows Birth Certificate, Still Detained by ICE in Florida

U.S. Citizen, Juan Carlos Lopez Gomez, a 20-year-old Florida-born U.S. citizen, was arrested under the state’s controversial immigration law. Despite his mother presenting his birth certificate, Social Security card, and state ID in court, according to the Associated Press.

The charges were dismissed after a judge found no legal basis, but ICE still requested that he be held for 48 hours, sparking outrage because the agency does not have the authority to detain naturalized citizens.

The incident occurred after a traffic stop near the Georgia border, where Lopez Gomez and others in the car were arrested under a new Florida law, which is on hold, according to AP, making it a crime for people who are in the country illegally to enter the state, targeting undocumented entry

Advocates say his arrest highlights the risks of racial profiling, noting he was targeted despite having valid citizenship proof. A federal judge had already blocked enforcement of that law, raising questions about why it was applied at all.

No one should be arrested under that law, let alone a U.S. citizen,” said attorney Alana Greer. Lopez Gomez was only released after the media’s widespread coverage forced authorities to reconsider.
